I specialise in conducting mental capacity assessments for individuals, solicitors, and local authorities, ensuring compliance with the Mental Capacity Act 2005 and the Care Act 2014.

There are many situations where you or a loved one may need a capacity assessment, particularly when making complex decisions, appointing a Lasting Power of Attorney, selling a property, or updating a Will. If there are concerns about someone’s cognition, professionals may also request a mental capacity assessment. We offer face-to-face mental capacity assessments, which are formally recorded to support decision-making and identify if help is needed. It's important to note that capacity is both time- and decision-specific, so multiple assessments may be required for different decisions in social work practice.
If someone has lost capacity, an application may be required to the Court of Protection to assist in making a decision on their behalf. As part of the court processes, the Court of Protection requires a CoP 3 form to be completed by a relevant professional, which serves as a capacity assessment to confirm the individual's mental capacity status for the court. This form is often requested by a solicitor when they are helping you with the application process. We offer the completion of CoP 3 forms, including in scenarios such as applications for deputyship with the Court of Protection, which may also involve mental capacity assessments and considerations related to lasting power of attorney in social work practice.
All assessments will be completed with a full written report, which may be a standard mental capacity assessment or on the relevant Court paperwork if required. These mental capacity assessments can be shared with solicitors or other professionals involved in the decision-making processes, such as when establishing a lasting power of attorney for you or a family member.
